These Terms of Use are the agreement between you and WinWinLabs. They cover this website and every WinWinLabs project offered through it. By creating an account, entering a fundraising campaign, making a donation, buying credits, buying a ticket, or simply continuing to use the site, you are agreeing to them.

We change these terms from time to time. The version you are reading, and the date it took effect, are printed at the top of this page. When a change is material we ask you to agree again the next time you sign in, and we keep a record of which version you accepted and when.

1. Who we are

WinWinLabs is a 501(c)(3) non-profit organization, IRS number 84-4720243, approved since March 2020. We run a platform that combines fundraising campaigns, events and education: people donate, play, and compete, and a share of what is raised goes to a cause.

Two words, and they mean different things here. A fundraising campaign is what you pay into: it has a cause behind it, a published split, and sometimes a prize. A game is what you play inside one — Minecraft, a puzzle, a challenge. Everything below says which one it means.

2. Your account

• Reading this site and holding an account are open to people of any age.
• You give us accurate information when you register, and you keep it current — particularly your email address, because that is how we reach you about your money.
• You are responsible for what happens under your account. Keep your password to yourself, and tell us at [email protected] if you think somebody else has it.
• One person, one account. Accounts are not transferable.

3. Age

There is not one age limit, because we do not do one thing.

• Reading the site and holding an account: any age.
• Anything that costs money: 18. That includes buying credits, donating, buying a ticket, paying an application fee, subscribing, and entering any fundraising campaign that costs something. We ask for your date of birth the first time you try to do one of these, and we store it once.
• Under 18, by exception, with a parent or guardian. Some events, some applications, and some campaigns and prizes are open to younger participants. Those run on parent or guardian approval, which we record against your account before you can take part. We do not treat a missing record as permission.

If you are under 18 and something on this site let you spend money anyway, tell us and we will refund it.

4. Credits

Credits are the unit this platform runs on. You buy them with a card, a bank account, or PayPal; you spend them on campaign entries and donations; and you can cash them out.

• Credits are not money and they are not a deposit. They are a balance on our books that you may redeem as described here.
• What you receive is the amount charged, less the payment processor's fee. Our processors charge a percentage plus a fixed amount per transaction and that comes off before your balance is credited. The receipt for every purchase shows both numbers.
• Credits do not expire and we do not charge a maintenance or inactivity fee.
• You can cash out to PayPal or to a connected Stripe account. Payouts are subject to those providers' own requirements, including identity verification, and to any minimum we publish at the time.
• We may hold or reverse credits obtained through error, fraud, a reversed payment, or a breach of these terms.

5. Campaigns, prizes and skill

• Our campaigns are decided by skill and a competitive system for choosing winners. Some of the games played inside them contain an element of chance, and for that reason paid entry is not permitted everywhere. Where we know a campaign is restricted in your location, we block it; where the position is unclear, you are telling us you may lawfully take part.
• Prizes may be credits, cash, or goods and services. What a particular campaign awards, and the rules for winning it, are shown on that campaign.
• Taxes are yours. If your net winnings reach $600 in a tax year we will ask for the information needed to issue a Form 1099 to you and to the IRS. We do not give tax advice.
• Cheating, automation, multiple accounts, or manipulating a campaign or the game inside it means disqualification, forfeiture of prizes, and closure of your account.
• Play within your means. Paid entries are a donation with a chance of a prize, not an investment.

6. Donations and fundraising

Donations, what part of one is tax deductible, and what we do with the money are covered by the Donation Terms and Donor Disclosures. What a nonprofit or cause named as a beneficiary is promised is covered by the Beneficiary Terms. Both are part of this agreement.

7. Payments and refunds

We do not hold your card. Payments are taken by Stripe and PayPal, who are responsible for that data under their own terms.

When you place an order it is an offer to buy, which we accept by delivering. Prices and availability can be wrong; if we find an error we will tell you and explain your options rather than charge you the wrong amount.

What is refundable, how long you have, and where the money goes back to are set out in the Refund Policy, which is part of this agreement. The short version: refunds are returned to your WinWinLabs credit balance, and credits can be cashed out.

If something looks wrong on your statement, contact us before disputing the charge with your bank. A chargeback filed without contacting us first may result in the account being suspended while we work it out.

8. What you may not do

You must not misuse this service. Specifically, do not: break the law or encourage anyone else to; upload malware; attempt to access parts of the system that are not yours; interfere with its operation or with other people's use of it; scrape or resell our content; send unsolicited advertising; impersonate anybody; or cheat.

9. What you post

User content is anything you make public here — text, images, photos, audio, video, location data, ratings, reviews, messages. You keep ownership of it, and you give us a non-exclusive, worldwide, royalty-free license to host, display and distribute it in connection with running and promoting the platform.

By posting, you confirm that it is yours to post, that it does not break the law or anyone else's rights, and that nobody paid you to post it without saying so. We do not check it in advance, and we can remove anything.

10. Our content

The software, design and content we supply belong to WinWinLabs or our licensors. You may view, store and print it for your own personal use of this service. You may not republish it, build a commercial product out of it, or pass it off as yours.

11. Links to other sites

We link to other sites and projects, some of ours and some not. We are not responsible for what is on a site we do not run, or for what it does with your information.

12. Availability

We try to keep the service running and we do not promise that it always will be. We may change, suspend or withdraw any part of it, and we may restrict access while we work on it. Where an outage costs you a campaign entry, the Refund Policy says what we do about it.

13. Ending the agreement

You can close your account at any time by writing to [email protected]. Cash out any credits first; we will help you if the balance is below a payout minimum.

We may suspend or close an account that breaks these terms, that we reasonably believe is being used for fraud, or that we are required to close by law. Where we can, we tell you first and give you a chance to put it right, and we return any credit balance that is properly yours.

14. Disclaimer and limit of liability

The service is provided as it is. To the fullest extent the law allows, we exclude the implied warranties, and we are not liable for indirect, special, consequential or punitive damages, lost profits, lost data, or damage to reputation.

To the fullest extent the law allows, our total liability to you for any claim connected with this service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, and (b) one hundred dollars.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.

15. You cover us

If someone brings a claim against us because of something you did here — what you posted, how you used the service, or a term you broke — you will cover the resulting costs and damages, and we will tell you promptly and let you take part in the defense.

16. Complaints and disputes

Start with us: email [email protected] with what happened and what you would like done. We answer every complaint, and most things are settled there.

If we cannot settle it, you and WinWinLabs each agree to give the other written notice and sixty days to resolve it before starting a formal proceeding.

17. Governing law

These terms are governed by the laws of the State of Michigan and the laws of the United States, without regard to conflict-of-laws rules. The state and federal courts located in Michigan have exclusive jurisdiction, and you and WinWinLabs each consent to that venue.

This service is offered from the United States and is intended for people in the United States. We do not currently offer it to residents of the European Union or the United Kingdom.

18. The rest

• If a clause turns out to be unenforceable, the rest stands, and the clause is read as narrowly as it needs to be to work.
• If we do not enforce something straight away, we have not given it up.
• These terms, together with the policies they name, are the whole agreement between us on this subject.
• You may not transfer your rights under this agreement. We may transfer ours if the organization is reorganized or merged, and your rights are unaffected.

This policy says what we collect, who receives it, how long we keep it, and what you can ask us to do with it. It covers this website and the WinWinLabs projects offered through it.

What we collect

What you give us

• When you register: your first and last name, username, email address and country. We do not ask for your date of birth at this point.
• The first time you do something that costs money: your date of birth, so we can apply the age rules in the Terms of Use. We store it once.
• If you cash out or win enough to be reported: the tax details required for a Form W-9 and a Form 1099, including your taxpayer identification number, and a mailing address.
• If you use the profile, address or event features: whatever you enter there, including postal addresses.
• Anything you post: content, messages, ratings, feedback, and images you upload.

What we record as you use the site

• Your transactions — purchases, donations, campaign entries, prizes and payouts. We keep the record; we do not keep your card number.
• Log information: IP address, browser and device, pages requested, and the time.
• Which invite or campaign link brought you here, so the right person or cause is credited.
• If you have allowed analytics cookies, aggregate usage measured by Google Analytics.
• Your cookie choices, and — for the agreements that require it — which version of a policy you accepted, when, and from which IP address.

What we do with it

• Run your account, take payments, pay you out, and run the campaigns and events you take part in.
• Tell you what is happening with your money and your entries.
• Meet legal obligations — tax reporting, record keeping, and responding to lawful requests.
• Keep the platform safe: detect fraud, cheating and abuse.
• Understand which parts of the site people use, and improve them.
• Tell you about things we think you would want to hear about. You can stop these at any time from your notification preferences or from the unsubscribe link in the email; that does not stop the messages we have to send you about your account and your money.

Who receives it

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We run no advertising pixels on this site.

Information does reach the following, each because it is needed to run the service:

We also disclose information when the law requires it, when we need to protect someone's safety or our rights, and — if the organization were ever reorganized or merged — to the successor, who would be bound by this policy.

Cookies

Every cookie this site sets is listed in the Cookie Policy, with what it is for and how long it lasts. You choose which of the optional ones run, and you can change your mind at any time from the link in the footer. We honor the Global Privacy Control signal if your browser sends one.

Payment information

We do not store card numbers or bank account numbers. Those go directly to Stripe or PayPal. What we keep is the record of the transaction: amount, date, method description (for example "card ending 4242"), and its reference.

Keeping it safe

Traffic to and from this site is encrypted. Access to personal information is limited to the people who need it to do their job. The most sensitive data — card details — is deliberately not ours to hold.

No system is perfectly secure. If we ever have a breach affecting your information we will tell you and the authorities we are required to tell, without undue delay.

How long we keep it

• Account information: while your account is open, and for a period after you close it so we can settle disputes and meet our obligations.
• Financial records, including tax reporting: seven years, which is what US tax record keeping requires.
• Consent and acceptance records: for as long as the agreement they evidence could matter, which in practice means the life of the account plus the same period.
• Log data: a rolling window, typically months rather than years.
• Analytics: according to Google's retention setting for our property.

Your choices

• See it. Ask us for a copy of the personal information we hold about you.
• Correct it. Most of it you can edit in your profile; for the rest, ask.
• Delete it. Ask us to close your account and delete what we hold, except the financial and tax records we are required to keep.
• Stop the marketing. Unsubscribe, or change your notification preferences.
• Turn off optional cookies. From the footer link, at any time.
• Do Not Sell or Share. We do not sell or share personal information for advertising. The footer link is there anyway, because you should not have to take our word for it — using it switches off analytics as well.

To exercise any of these, email [email protected] from the address on your account, or write to us and tell us how to reach you. We answer within 45 days. We will not treat you differently for asking.

Children

Reading this site and holding an account are open to any age; spending money is 18, with the exceptions described in the Terms of Use. If you are a parent or guardian and you believe a child has given us information you would rather they had not, email [email protected] and we will remove it.

Where we operate

We are in the United States and your information is processed here. We do not currently offer this service to residents of the European Union or the United Kingdom, and we are not currently set up to meet the obligations that come with doing so.

When this changes

The version you are reading and the date it took effect are printed at the top of this page. When a change is material we ask you to agree again the next time you sign in, and we email registered users. Older versions are available on request.
